These Terms of Service ("Terms") govern your access to and use of the Mailrith platform, including our website, applications, and APIs (collectively, the "Service"), operated by Mailrith ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

If you are using the Service on behalf of an organization, you are agreeing to these Terms on behalf of that organization and you represent that you have the authority to do so.

1. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you do not meet this requirement, you must not access or use the Service.

2. Your Account

To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately if you believe your account has been compromised.

You may not share your account credentials with others, transfer your account, or create accounts using automated means. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

4. Email Sending and Deliverability

Mailrith is a platform that enables you to send email using your own third-party email delivery provider (SMTP). You are solely responsible for:

• — Maintaining valid subscriber consent in accordance with applicable laws
• — Honoring unsubscribe requests promptly
• — Compliance with all applicable email marketing laws and regulations
• — Your sending reputation with your chosen email delivery provider

5. Subscriptions and Billing

Mailrith offers a free plan and paid subscription plans. Paid plans are billed on a recurring monthly basis. You authorize us to charge your payment method on the billing date indicated in your account settings.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods unless required by applicable law.

We reserve the right to change our pricing with at least 30 days' notice. Continued use of the Service after a price change constitutes your agreement to the new pricing.

6. Your Content and Data

You retain all rights to the content you upload to and generate through the Service, including your subscriber data, email templates, and campaign data ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to process Your Content solely to provide the Service to you.

You can export Your Content at any time. Upon termination of your account, we will retain Your Content for 30 days to allow you to retrieve it, after which it may be permanently deleted.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Mailrith and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

We do not warrant or guarantee any specific email deliverability rates, open rates, or marketing outcomes. Results may vary based on your content, audience, and sending practices.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Mailrith shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Mailrith and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, Your Content, or your violation of these Terms or applicable laws.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other business reason.

You may terminate your account at any time by contacting us or using the account deletion feature in your account settings.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by emailing the address associated with your account or by displaying a notice in the Service. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.
