# Mailrith Terms of Service

## 1. Agreement to These Terms

Mailrith is operated by Rawool Publications. In these Terms, "Mailrith," "we," "us," and "our" refer to the Mailrith service and the team operating it.

These Terms of Service explain the rules for using Mailrith, including our website, app, hosted pages, APIs, and related services.

By creating an account, accessing Mailrith, or using the service on behalf of a business or organization, you agree to these Terms. If you use Mailrith for an organization, you confirm that you have authority to accept these Terms for that organization.

## 2. Eligibility

You must be at least 18 years old and able to enter into a binding agreement to use Mailrith.

You may not use Mailrith if you are barred from using the service under applicable law or if we previously suspended or terminated your account for abuse.

## 3. Accounts and Workspaces

You are responsible for the accuracy of your account information and for all activity under your account and workspaces.

You must protect your sign-in details, limit admin access to trusted people, and tell us promptly if you believe your account has been compromised.

You are responsible for actions taken by anyone you invite to your workspace or authorize to use your connected services.

## 4. Plans, Billing, and Trials

Mailrith may offer free and paid plans. Plan details, limits, prices, and renewal terms are shown on the pricing page, checkout page, or inside the app.

If you choose a paid plan, you authorize our payment provider to charge your selected payment method for the amount and billing period shown at checkout.

You can cancel a paid plan according to the options available in your account or by contacting support. Unless required by law, fees already paid are not refundable and cancellation takes effect at the end of the current billing period.

We may change plan prices or plan features in the future. If a change affects your paid plan, we will give reasonable notice before it applies.

## 5. Your Content and Subscriber Data

You keep ownership of the content and data you add to Mailrith, including Subscribers, tags, segments, custom fields, email templates, forms, landing pages, magic links, broadcasts, sequences, automations, and reports.

You give Mailrith permission to host, process, transmit, display, copy, and back up that content only as needed to provide, secure, support, and improve the service.

You are responsible for the accuracy, legality, and permissions for your content and Subscriber data.

## 6. Email Sending Rules

Mailrith is built for permission-based email marketing and customer communication. You must follow the email, privacy, consumer protection, and anti-spam laws that apply to you and your Subscribers.

- Send only to people you have permission to contact or another lawful basis to contact.
- Do not use purchased, rented, scraped, harvested, or third-party lists unless you can prove lawful permission for every recipient.
- Use accurate sender names, email addresses, subject lines, and reply-to details.
- Include required business identity and contact information in your emails when the law requires it.
- Honor unsubscribe and suppression requests promptly.
- Do not hide who you are, mislead recipients, or send deceptive email content.
- Keep your list clean and remove invalid, bounced, unsubscribed, or complaining recipients when needed.

## 7. Connected Services

Mailrith lets you connect services such as SMTP providers, AI providers, payment services, DNS providers, and other tools. Your use of those services is governed by their own terms and policies.

You are responsible for maintaining those accounts, keeping their credentials secure, paying their fees, and making sure your use of them is lawful.

If a connected service is unavailable, misconfigured, rate limited, suspended, or rejects your activity, Mailrith features that depend on that service may not work.

## 8. Prohibited Use

You may not use Mailrith in a way that harms people, damages the service, breaks the law, or abuses email infrastructure.

- Sending spam or unwanted bulk email.
- Phishing, impersonation, malware, credential theft, or attempts to bypass security controls.
- Collecting personal information without proper notice, permission, or lawful basis.
- Uploading or sending illegal, harmful, exploitative, deceptive, defamatory, or infringing content.
- Using Mailrith to harass, threaten, or discriminate against people.
- Interfering with Mailrith systems, testing for vulnerabilities without permission, scraping the service, or overloading the service.
- Reselling, sublicensing, or making Mailrith available as a competing product without written permission.

## 9. Deliverability and Email Results

Mailrith does not guarantee inbox placement, delivery rates, open rates, click rates, sales, or business results.

Deliverability depends on many things outside Mailrith's control, including your SMTP provider, domain setup, sender reputation, list quality, recipient servers, email content, sending volume, and recipient behavior.

We may provide tools, reports, and suggestions, but you are responsible for your sending practices and provider setup.

## 10. APIs and Developer Use

If you use Mailrith APIs, webhooks, or developer tools, you are responsible for the applications and automations you build.

You must keep API keys secure, use reasonable rate limits, avoid excessive requests, and not use the API to bypass product limits, security controls, or user permissions.

## 11. Privacy and Data Protection

Our Privacy Policy explains how we handle personal information. You must provide any notices, permissions, and choices required for the people whose data you collect or upload to Mailrith.

If privacy laws require a data processing agreement or similar document for your use of Mailrith, contact us before using the service for regulated data.

## 12. Mailrith Property and Feedback

Mailrith owns the service, software, design, brand, documentation, and other materials we provide. These Terms do not transfer ownership of Mailrith to you.

If you send us ideas, suggestions, or feedback, you allow us to use them without restriction or payment to you.

## 13. Suspension and Termination

You may stop using Mailrith at any time. You are responsible for exporting any data you want to keep before closing your account.

We may suspend or terminate access if we believe you violated these Terms, created risk for Mailrith or others, failed to pay fees, caused deliverability or abuse issues, or used the service unlawfully.

After termination, we may delete or retain data as described in our Privacy Policy and as needed for legal, billing, security, backup, or abuse-prevention reasons.

## 14. Service Changes and Availability

We may change, add, remove, or limit features as Mailrith evolves. We try to keep the service reliable, but we do not promise that Mailrith will always be available, uninterrupted, or error-free.

Some features depend on third-party providers, internet access, browser support, DNS, SMTP settings, and other systems outside our control.

## 15. Disclaimers

Mailrith is provided on an as-is and as-available basis. To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

Nothing in Mailrith is legal, tax, deliverability, or compliance advice. You are responsible for deciding whether Mailrith is suitable for your business and legal requirements.

## 16. Limitation of Liability

To the fullest extent allowed by law, Mailrith will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost goodwill, lost data, or business interruption.

To the fullest extent allowed by law, Mailrith's total liability for claims related to the service or these Terms will not exceed the amount you paid to Mailrith for the service in the 12 months before the event giving rise to the claim.

## 17. Indemnity

You agree to defend, indemnify, and hold Mailrith harmless from claims, losses, damages, liabilities, costs, and expenses arising from your content, Subscriber data, sending practices, connected services, violation of these Terms, or violation of law.

## 18. Changes to These Terms

We may update these Terms from time to time. When changes are material, we will take reasonable steps to notify you, such as posting a notice in the app or sending an email to the account email address.

Your continued use of Mailrith after updated Terms take effect means you accept the updated Terms.

## 19. Disputes

If you have a concern, contact us first so we can try to resolve it informally.

Any dispute will be handled by the courts or other forums that have lawful authority over the matter, unless applicable law requires a different process.
