This Privacy Policy describes how Mailrith collects, uses, discloses, retains, and otherwise processes information about Mailrith customers ("Customers"), account users, website visitors, support contacts, and others who interact with Mailrith.

Mailrith is operated by Rawool Publications. This Privacy Policy applies to information Mailrith collects when you access or use the Services, visit Mailrith websites, communicate with Mailrith, request support, participate in product or billing flows, or otherwise interact with Mailrith.

This Privacy Policy is intended to describe Mailrith's privacy practices and, where applicable, provide privacy disclosures for information Mailrith controls. Additional just-in-time notices, consent language, product settings, or regional notices may apply to particular features or processing activities.

Mailrith may provide different or additional privacy notices for certain offerings, regions, transactions, or features. Those notices supplement or replace the disclosures in this Privacy Policy for the applicable offering, region, transaction, or feature.

This Privacy Policy does not, by itself, govern Mailrith's processing of Customer-controlled Subscriber Personal Information as a processor, service provider, contractor, or similar role. That processing is addressed in the Data Processing Addendum to the extent the Data Processing Addendum applies.

This Privacy Policy should be read together with the Terms of Service and, where applicable, the Data Processing Addendum.

Except to the extent expressly required by applicable law, the Terms of Service, the Data Processing Addendum where applicable, or another written agreement signed by Mailrith, this Privacy Policy does not create contractual rights, service-level commitments, warranties, representations, guarantees, fiduciary duties, professional duties, or third-party beneficiary rights.

Mailrith may change this Privacy Policy from time to time. If Mailrith makes changes, Mailrith may revise the date above, provide notice through the Services, send an email, or use another notice method where required by law or where Mailrith otherwise chooses to do so.

## Collection Of Information

The information Mailrith collects depends on how you interact with the Services. Mailrith may collect information directly from you, automatically when you use the Services, from Customers that use the Services, from service providers, from connected providers, and from other sources as permitted by applicable law.

Information you provide to us may include account information, workspace information, billing and transaction information, support communications, form or landing-page content, email content, templates, imports, exports, API payloads, and other information you choose to provide.

Information collected automatically may include IP address, browser type, device information, operating system, pages viewed, links clicked, app actions, timestamps, cookie identifiers, error logs, security logs, and similar usage or diagnostic information.

When you use a Mailrith deliverability test address, public test flow, or extension, Mailrith may receive the test email, sender details, headers, links, IP address, timestamps, usage logs, and security logs to produce the test result, troubleshoot the test, and protect the Services.

When you submit a Mailrith-controlled contact form, support form, product question form, or similar website form, Mailrith may receive the information you submit through that form, including forms powered by Formasty where used.

Mailrith may receive information from third-party sources, including payment providers, authentication providers, analytics providers, email delivery services, AI providers, abuse-reporting sources, Customer-connected providers, and public sources.

Mailrith may derive information from information available to it, including approximate region from IP address, delivery status from provider events, or abuse indicators from usage patterns.

- Identifiers and contact information, such as name, email address, username, account identifiers, sender identifiers, workspace details, postal address, and billing contact details.
- Commercial and transactional information, such as plan, subscription, invoice, payment status, tax details, purchase history, support history, and related records.
- Internet, device, usage, and security information, such as IP address, browser, device, pages viewed, app actions, timestamps, cookie identifiers, error logs, security logs, and similar diagnostics.
- Customer Content and communications, such as forms, landing pages, email content, templates, imports, exports, API payloads, support messages, and attachments.
- Subscriber-related information controlled by Customers, such as names, email addresses, tags, segments, custom fields, consent records, suppression records, engagement events, form submissions, and similar records.
- Approximate location, inferences, and derived information, such as region inferred from IP address, delivery status from provider events, or abuse indicators from usage patterns.

## Subscriber Personal Information

Customers may submit, collect, import, store, segment, email, automate, export, delete, or otherwise process information about their Subscribers through the Services.

When Mailrith processes Customer-controlled Subscriber Personal Information on behalf of a Customer, that processing may be subject to the Data Processing Addendum, Customer instructions, and the Terms of Service.

Customers determine what Subscriber Personal Information is submitted to Mailrith, why it is processed, which connected providers receive it, what notices and consents are required, and when it is exported, suppressed, deleted, or otherwise acted upon.

If a Subscriber contacts Mailrith directly regarding Customer-controlled Subscriber Personal Information, Mailrith may direct the Subscriber to the relevant Customer unless applicable law requires Mailrith to respond directly.

## Use Of Information

Mailrith may use information to provide, maintain, secure, support, analyze, and improve the Services; create and administer accounts and workspaces; process payments, subscriptions, invoices, tax details, and billing support; send transactional, security, support, legal, product, and administrative communications; monitor and analyze trends, usage, and activities; detect, investigate, prevent, and respond to spam, abuse, fraud, security incidents, provider complaints, Subscriber complaints, unlawful activity, and violations of applicable terms; create aggregated or de-identified information; and comply with legal, financial, tax, security, accounting, dispute, and enforcement obligations.

Mailrith may use Customer-controlled Subscriber Personal Information to provide the Services, follow Customer instructions, operate and secure the Services, prevent abuse, comply with law, and enforce applicable terms, subject to the Terms of Service and Data Processing Addendum where applicable.

Nothing in the Services is legal, privacy, deliverability, tax, financial, security, or other professional advice. Customers are responsible for determining whether the Services and their settings are appropriate for their own business and legal obligations.

## Legal Bases And Required Information

Where applicable law requires a legal basis for processing, Mailrith may rely on contract, consent, legal obligation, legitimate interests, certain legitimate uses, establishment or defense of legal claims, protection of the Services, compliance with law, or another basis available under applicable law.

Mailrith's legitimate interests may include providing, securing, maintaining, analyzing, improving, marketing, and enforcing the Services; preventing spam, fraud, abuse, and security incidents; responding to support requests; managing billing; and protecting Mailrith, Customers, Subscribers, providers, and others.

Some information is required to create an account, maintain a workspace, process billing, provide support, secure the Services, comply with law, or provide requested features. If required information is not provided, the Services or affected features may be unavailable, delayed, suspended, or incomplete.

Where consent is the basis for processing, consent may be withdrawn as permitted by applicable law. Withdrawal does not affect processing that occurred before withdrawal and may not affect processing based on another lawful basis.

Where applicable law requires privacy or consent notices to be available in a particular language or format, Mailrith may provide such notice through the Services, by email, through support, or by another method Mailrith makes available or applicable law requires.

## Children And Sensitive Information

The Services are not directed to children, and Mailrith does not knowingly collect personal information from children through Mailrith-controlled account, billing, marketing, or support flows.

Customers may not use the Services to collect, import, store, send, or otherwise process personal information about children, special categories of personal data, sensitive personal information, health data, biometric identification data, genetic data, payment card numbers, government identity numbers, passwords, or similarly sensitive information unless the Customer has all required authority and Mailrith has expressly approved the use in writing.

Mailrith's current Services are not intended to knowingly sell, share, use for targeted advertising, track, or behaviorally monitor personal information about children where doing so is prohibited by applicable law.

If you believe a child has provided personal information to Mailrith through a Mailrith-controlled account, billing, marketing, or support flow, contact support@mailrith.com.

## Automated Processing And AI

Mailrith may use automated systems, rules, models, or signals to operate, secure, support, analyze, improve, and enforce the Services, including for spam prevention, abuse detection, fraud prevention, security monitoring, deliverability diagnostics, rate limits, billing checks, and product analytics.

Mailrith's current Services are not intended to make decisions based solely on automated processing that produce legal or similarly significant effects for individuals. If Mailrith later offers or uses such processing, any notice or choice will be governed by applicable law and the terms or notices then made available for the relevant feature.

Customer-connected AI providers, prompts, outputs, integrations, and workflows are controlled by the Customer. Customers are responsible for determining whether their use of AI providers with Customer Content or Subscriber information is lawful and appropriate.

## Targeted Advertising And Analytics

Mailrith may use analytics, attribution, cookies, pixels, similar technologies, or marketing providers to understand use of Mailrith-controlled websites, sign-up flows, product pages, billing flows, or marketing communications.

Depending on the technology used and the law that applies, these activities may be considered sales, sharing, or targeted advertising. Any notices or choices for such activities are subject to the applicable law, the technology used, available controls, and Mailrith's then-current implementation.

Mailrith's current Services are not designed to use Customer-controlled Subscriber Personal Information to advertise to a Customer's Subscribers, operate an advertising network, operate a sponsorship marketplace, operate an ad marketplace, or provide a programmatic advertising service.

You may be able to limit cookies or similar technologies through browser controls or legally recognized opt-out signals. Mailrith may honor Global Privacy Control or similar opt-out signals where required by applicable law. Mailrith does not respond to browser Do Not Track signals unless applicable law requires otherwise.

Some parts of the Services may not function correctly if required cookies or similar technologies are disabled.

## Disclosure Of Information

Mailrith may disclose information as described in this Privacy Policy, the Terms of Service, the Data Processing Addendum, Customer instructions, consent, or as otherwise permitted or required by applicable law.

- Vendors and service providers that assist with hosting, storage, database infrastructure, security, payment processing, billing, email delivery, analytics, form hosting, support intake, fraud prevention, abuse prevention, and service operations.
- Form and support tools, including Formasty where used for Mailrith contact or support forms, that collect, route, store, notify, or manage messages submitted to Mailrith.
- Customer-connected services, such as email delivery services, AI providers, webhooks, Zaps, CRMs, API clients, payment tools, DNS providers, and other systems selected or authorized by the Customer.
- Other workspace users or the public where a Customer configures the Services, publishes hosted pages, sends emails, uses public links, invites users, assigns roles, or otherwise makes information available.
- Law enforcement authorities, courts, regulators, government authorities, litigants, and other parties where Mailrith believes disclosure is in accordance with or required by law or reasonably necessary to protect rights, property, safety, security, or the Services.
- Professional advisors, including lawyers, auditors, insurers, accountants, security advisors, and similar advisors where reasonably necessary to obtain advice or protect and manage business interests.
- Transaction participants in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction.
- Other persons with consent or at the direction of the Customer or individual to whom the information relates.

## Data Retention

Mailrith may retain information for as long as reasonably necessary to provide the Services, maintain accounts and workspaces, comply with law, resolve disputes, enforce agreements, process billing, maintain security, prevent abuse, honor suppression or unsubscribe choices, and carry out other purposes described in this Privacy Policy.

Retention periods may vary based on the information category, account status, workspace settings, Customer instructions, provider requirements, legal obligations, billing needs, tax and accounting requirements, security needs, backup cycles, dispute needs, abuse-prevention needs, and technical limitations.

Backup copies, logs, archives, and provider-held records may remain for a limited period and may not be immediately removed from every system when an account-level or Subscriber-level deletion action is taken.

Mailrith may retain aggregated or de-identified information that cannot reasonably be used to identify an individual, Customer, or Subscriber.

## Your Choices

Account users may be able to access, correct, export, or delete certain information through the Services, depending on account status, workspace permissions, available product controls, and legal or technical limitations.

Promotional communications from Mailrith may include opt-out instructions. Mailrith may continue sending non-promotional communications about accounts, transactions, billing, security, legal notices, support, and the Services.

A browser or device may allow cookies and similar technologies to be removed, rejected, or limited. Removing or rejecting cookies may affect the availability or functionality of the Services.

Subscribers should ordinarily contact the sender or list owner regarding Customer-controlled Subscriber Personal Information.

Mailrith designates support@mailrith.com as the contact for privacy requests, consent-withdrawal requests, privacy grievances, and questions about Mailrith-controlled personal information. Requests should include enough information for Mailrith to verify the requester, identify the relevant account, workspace, transaction, or Subscriber context, and evaluate the request.

Where applicable law permits an authorized agent, nominee, guardian, or similar representative to act on behalf of an individual, Mailrith may require proof of authority, identity verification, direct confirmation from the individual, or other information permitted by law.

Where applicable law gives an individual a grievance-redressal right or requires a complaint to Mailrith before approaching a regulator, the individual should contact support@mailrith.com first and include the request, concern, relevant account or workspace context, and any prior correspondence.

## Additional Information For Specific Jurisdictions

Some jurisdictions have enacted privacy laws that grant residents certain rights and require specific disclosures. These laws may include CCPA/CPRA, the Colorado Privacy Act, the Connecticut Data Privacy Act, the Virginia Consumer Data Protection Act, the Utah Consumer Privacy Act, GDPR, UK GDPR, Swiss privacy law, and similar laws.

Mailrith may fall below the thresholds for some privacy laws. Mailrith nevertheless provides this section for transparency and to the extent those laws apply to Mailrith.

To the extent the CCPA/CPRA or another state privacy law applies, this section, together with the Collection Of Information, Use Of Information, Disclosure Of Information, Data Retention, Targeted Advertising And Analytics, and Your Choices sections, is intended to serve as Mailrith's notice at collection for Mailrith-controlled personal information.

When Mailrith processes Customer-controlled Subscriber Personal Information on behalf of a Customer, Mailrith generally processes that information as a processor, service provider, contractor, or similar role subject to the Data Processing Addendum, rather than under this Privacy Policy alone.

Depending on where you reside and the law that applies, you may have the right to request access to personal information, receive a portable copy, request correction, request deletion, opt out of certain processing, restrict or object to certain processing, withdraw consent, and appeal a denied request.

Mailrith generally does not collect information considered sensitive personal information under US state privacy laws for the purpose of inferring characteristics about you. The Services are not designed for Customers to submit special categories of personal data or highly sensitive information inside Subscriber fields, Customer Content, forms, landing pages, or email content.

Mailrith's current Services are not intended to knowingly sell, share, or use for targeted advertising personal information about consumers Mailrith knows to be under 18.

Mailrith's current Services are not intended to offer financial incentives, price differences, or service differences in exchange for the sale, sharing, retention, or disclosure of personal information unless Mailrith separately makes available any notice required by applicable law.

To make a privacy request about personal information Mailrith controls, contact support@mailrith.com. Mailrith may verify a request using information already available to Mailrith, including account email address, workspace context, prior transactions, support history, or other reasonable verification information.

If applicable law gives you an appeal right and Mailrith denies your request, you may appeal by contacting support@mailrith.com and including the original request, the denial, and the reason you believe the decision should be reviewed.

If you are located in Europe, the United Kingdom, or Switzerland, Mailrith may rely on contract, legitimate interests, legal obligation, consent, or another lawful basis recognized by applicable law. You may have the right to lodge a complaint with the data protection authority where you reside.

If you are located in India, you may have rights under the Digital Personal Data Protection Act, 2023 and related rules when applicable, including rights to access information about personal data, correction, completion, updating, erasure, grievance redressal, consent withdrawal, and nomination. You may also have the right to complain to the Data Protection Board of India after using the grievance-redressal process required by applicable law.

## International Transfers

Mailrith is operated by Rawool Publications in India. Mailrith and its service providers may process, store, access, transfer, and disclose information in countries other than the country where you or your Subscribers are located.

Where applicable law requires a transfer safeguard, Mailrith may rely on the European Commission Standard Contractual Clauses (SCCs), the UK International Data Transfer Addendum to the SCCs, the UK International Data Transfer Agreement (IDTA), Swiss transfer terms or modifications, adequacy decisions, derogations, Customer instructions, or another transfer mechanism available for the transfer.

Mailrith does not claim certification under the EU-US, UK-US, or Swiss-US Data Privacy Framework unless Mailrith separately publishes such certification.

Customer-connected providers may process information in regions selected, configured, or accepted by the Customer. Customers are responsible for reviewing those providers' transfer, hosting, security, and retention practices.
